How Our 3-Step Pool & Spa Compliance Inspection Works

Pool and Spa owners must register Pool or Spa with their local council before the deadline of November 1, 2020.

Schedule a Certificate of Compliance or a Compliance Consultation inspection with Pool & Spa Safety Compliance Victoria.

If your Pool or Spa is found to be non-Compliant during the initial inspection, owners will be required to undertake the required works, detailed in the Inspection report (within a maximum of 60 days? to make barrier Compliant. Once all works are completed, a mandatory re-inspection will be required to ensure all identified non-Compliant items meet the applicable Australian Standard.

The Owner must lodge their Compliance Certificate with their local Council, within 30 days from time of issue. The Owner has now fulfilled their legal obligations with Victorian legislation. The Owner will be required to obtain a new Barrier Compliance Certificate every 4 years, which is calculated from the date of your last Certificate.

Barrier Compliance Certificate

Barrier Compliance Certificate

The Certificate of Barrier Compliance is a document issued by a registered inspector / surveyor, which signifies that your safety barrier meets the necessary standards. As a landowner with a Pool or Spa, you will submit this certificate of compliance to your local council within a 30-day timeframe from the date it was issued.

Upon receiving the certificate, your council is responsible for:

  • Providing a written notice confirming the submission date of the certificate.

  • Specifying a due date for the next certification submission, which is set four years from the date of the previous submission.

When submitting your barrier Compliance Certificate, a council fee will be required.

What is the barrier compliance for swimming pools in Victoria?

If a swimming Pool or Spa can hold more than 300 mm (30 cm) of water, it needs to have a compliant safety barrier. This is to prevent young children (under five years old) from getting into the Pool area by themselves.

How often do pools need to be inspected in Victoria?

In Victoria, all Spa or Pool safety barriers must be inspected every four years. This timeframe aligns with the requirement from the council that a Certificate of Barrier Compliance must be lodged every four years. This ensures your Pool or Spa is consistently maintained and meets the necessary safety standards.

Can you sell a house with a non-compliant pool in Victoria?

Yes, you can sell a house in Victoria even if its Pool and Spa barrier is not Compliant (meet all the rules). But the sale contract needs to have a "non-compliance certificate" included. The new owner has three months to fix the Pool or Spa non-Compliant issues to receive a "Compliance Certificate”.

How long does a pool compliance certificate remain valid in Victoria?

Once your Pool or Spa Certificate of barrier Compliance is lodged within 30 days of its issue date, it will remain valid for 4 years, when your next mandatory Compliance Certificate Inspection is due from date of issue.
