Issuance of Compliance Certificate

Issuing a Compliance Certificate: At the conclusion of the Pool or Spa Safety Barrier Inspection, if we find your safety barrier is compliant, Pool & Spa Safety Compliance, Victoria, will issue you with a Safety Barrier Compliance Certificate, Form – 23.

  • When the Pool or Spa was built / construction date?
  • Its Applicable Construction Standard?
  • When Owners MUST Lodge a Certificate of Compliance with Council?

Deadlines For Registration

The relevant dates for the registration of your pool or spa are outlined in the tables below.

Permanent Pool or Spa

Final Date for Lodging Application for Registration
Construction of pool or spa was completed before 1st November 2020
The later of:

30 days after the date of issue of the occupancy permit
or certificate of final inspection, or 1st November 2020
Construction of pool or spa commenced before 1st November 2020 but completed after 1st November 2020
30 days after the date of issue of the occupancy
permit or certificate of final inspection
Construction of the pool or spa commenced and completed after 1st November 2020. This means that the building permit for the pool or spa was issued:
  • on or after 1 November 2020, or
  • before 1st November 2020, but construction of pool or spa did not commence until after this date
You must lodge the certificate of barrier compliance at the same time as your registration application.
Relocatable Pool or Spa

Pool and Spa Registration Requirements

New regulations have been implemented to enhance the safety of Swimming Pools and Spas in Victoria. It is now obligatory for Owners with a Swimming Pool or Spa located on their land to register them with the appropriate council. These regulations pertain to any Swimming Pool or Spa which is capable of holding water 300mm (30 cm), including permanent Pools, Spas, Above Ground Pools, Indoor Pools, Hot Tubs, Bathing or Wading Pools and some relocatable Pools.

Notably, relocatable Pools that are comprised of a single piece and do not require assembly are excluded from the barrier requirements. For instance, a small inflatable pool that simply needs to be inflated falls into this category. Alongside registration, Pool and Spa Owners must acquire and file compliance certifications for their safety barriers. More information can be found under Safety Barrier Regulations.

Deadlines for Registration

In Victoria, the law mandates that all residential Pools and Spas must be registered with their respective local council. This registration requirement is directed towards ensuring safety standards and preventing accidental drownings. It is important to note that you must register your Pool or Spa within the given deadlines. Non-compliance with these deadlines, whether for permanent Swimming Pool / Spa or relocatable Swimming Pool/ Spa, may result in penalties.

What Happens After You Register Your Pool or Spa?

Upon registration of your Pool or Spa, the concerned council is obliged to send you a written confirmation including:

  • Acknowledgment of your Pool or Spa's registration
  • The construction date of your Pool or Spa along with the corresponding barrier standard
  • Your right to lodge an appeal with the Building Appeals Board (BAB) regarding the council's decision on the Pool or Spa's construction date
  • A deadline indicating when the initial or following Certificate of Barrier Compliance needs to be submitted to the relevant council
